Frequently Asked Questions
Common questions about uncontested divorce
An uncontested divorce is when both spouses agree on the major terms of their divorce, including custody, parent-time, alimony, and division of marital property. When the couple is aligned on the big-picture issues, the process is faster, simpler, and far less stressful than a traditional litigated divorce.
If you complete your uncontested divorce through JR Mediation Group, you can finalize all the terms and sign a settlement agreement in a single day. Utah law requires a 30-day waiting period before a judge can sign the final decree. After your agreement is reached, JR Mediation Group prepares all documents, files them after the waiting period, and provides the signed final decree once the court completes it.
Usually, no. In Utah, most uncontested divorces are completed entirely through paperwork. If you and your spouse agree on the terms, JR Law Group or JR Mediation Group will handle all filings so you can finalize your divorce without ever appearing in a courtroom.
One attorney cannot represent both spouses. However, an uncontested divorce can still be completed with the help of one attorney as long as it is clear which spouse is the client and the other spouse understands they are not represented. The non-represented spouse may review a waiver or choose to have an independent attorney review the agreement.
If your agreement is reached through JR Mediation Group, the mediator will prepare all required court documents, including the Affidavit of Jurisdiction and Grounds, Child Support Worksheets, and the Final Proposed Divorce Decree. They will also file everything with the court and take care of all final steps until your decree is signed.
